The Office of Inspector General (OIG) maintains the List of Excluded Individuals and Entities (LEIE) — a database of individuals and organizations banned from participating in federal healthcare programs like Medicare and Medicaid. Hiring or contracting with an excluded individual can result in Civil Monetary Penalties (CMPs) of up to $100,000 per occurrence, plus liability for any claims submitted. What is the OIG List of Excluded Individuals and Entities (LEIE)?
The LEIE is a database maintained by the Office of Inspector General (OIG) that lists individuals and entities excluded from participating in federal healthcare programs such as Medicare and Medicaid. Exclusions can result from criminal convictions, civil monetary penalties, or other offenses related to healthcare fraud, patient abuse, or licensing violations.
Why is exclusion screening required?
Federal law (42 U.S.C. § 1320a-7 and 42 CFR § 1001) prohibits healthcare organizations from employing or contracting with excluded individuals for services reimbursed by federal healthcare programs. The OIG recommends monthly screening to ensure ongoing compliance, and many state Medicaid programs require it.
Who needs to be screened?
All individuals and entities that provide services, are involved in billing, or have access to federal healthcare program funds must be screened. This includes employees, contractors, temporary staff, volunteers with patient contact, board members, vendors, and business associates.
How often should exclusion screening be performed?
The OIG recommends monthly screening of all employees, contractors, and vendors. At minimum, screening should occur at the time of hiring or contracting and on a regular, ongoing basis. Accountable automates monthly screening so you never miss a check.
